The Scientific conference entitled. "Emerging issues in licensing and enforcement of SEPs".

The Faculty of Law and Administration, jointly with the Institute of Legal Sciences of the Polish Academy of Sciences and the S.J. Quinney School of Law at the University of Utah, cordially invite you to a scientific conference entitled. "Emerging issues in licensing and enforcement of SEPs", which will be held on 7-8 September 2023 at the Staszic Palace, 72 Nowy Świat Street, Warsaw.

Patents covering a technology whose use is essential for the implementation of a standard are commonly known as standard essential patents (SEPs). The criteria for which SEP patents are necessary for undertaking include 5G, 6G, Wi-Fi and DVB technologies. Standardisation, on the other hand, is seen as an essential factor for innovation and competitiveness, and the use of SEP patents (especially for connectivity) will increase with the development of the Internet of Things.

However, regarding the licensing and enforcement of SEP patents, there are several issues and practices by both patent holders and standard implementers that are controversial,l leading to litigation currently underway in many parts of the world. These controversies include how the royalty for the use of the patented solution and other terms of the licence agreement, which should be fair, reasonable and non-discriminatory (FRAND).

Given the problems identified, many legislators around the globe have recognised the need for an efficient and predictable licensing and enforcement system for SEP patents for the unhindered development of new standards-based products and the digital economy. To this end, on 27 April 2023. The European Commission has announced a draft regulation on the patents needed to implement the standard, which is currently being legislated.

Throughout the planned conference, its organisers will subject selected issues related to licensing and enforcement of SEP patents in the context of the development of Internet of Things technologies to a broader discussion and analysis. We will also discuss potential ways of solving the perceived problems.
